These are the Terms and Conditions under which we contract for the sale of Goods listed on our website www.myskilocker.com . Please read these terms carefully before you order any goods from us as they must be agreed to by you before your order can be processed. These Terms and Conditions do not affect your statutory rights as a consumer. If you would like to speak to someone about them please send us an email or give us a call - we are here to help. All you need to do to get your hands on a bundle of ski gear is follow us on twitter and retweet the competition message.
The bundle consists of walkie-talkies, 2 sets of handwarmers, 2 sets of ski ties, a Mohawk hat, multi-functional headwear, 2 scarves and 2 sets of mitts – with a retail value of more than £100. The Competition is open until 6pm GMT Saturday 19/02/11.
1. Definitions and Interpretations
Reference to "us" ,"we" and "our" is a reference to Spacehouse Ltd trading as www.myskilocker.com
Reference to "you" is a reference to the Purchaser of the Goods from us.
"Goods" means any item purchased by you from us.
"Contract" means the contract between us and the Purchaser for the sale and purchase of the Goods which incorporates these Terms and Conditions.
"Terms" means these Terms and Conditions.

3. Our Guarantee
We want to make sure that shopping with us is an enjoyable experience so we are happy to give you a money-back guarantee if you are not 100% satisfied with your Goods for any reason whatsoever. All you have to do is follow our simple Returns Policy which is set out in paragraph 8 below.
4. Purchasing From Us
You warrant to us that all information which you are required to provide when ordering goods online is complete and accurate at the time of the order and that this information relates to you as the person placing the order and not to any third party.
When an order is placed by you online the order confirmation issued by the Company clearing the debit or credit payment does not constitute acceptance of your order by us. We are not obliged to supply the Goods to you until we have confirmed acceptance of your order by email or by phone and this is when the contract between us is made.
Payment for the Goods which you have ordered will be taken prior to despatching the Goods ordered - Goods will normally be sent within 24-48 hours of our Acceptance of your order. No payment will be processed more than 2 working days before Goods are despatched.
All payment for goods and for the Postage and packing must be made before the Goods are delivered. Ownership of the Goods does not pass to you until we have received payment in full.
We may accept, at our discretion, payment by cheque, if so, delivery will not occur until the cheque has been cleared.
6. Price and VAT
The price of Goods quoted on our Site is inclusive of VAT unless otherwise stated. The cost of postage and packing is shown seperately..

7. Order Confirmations
Shortly after you have placed your order we will acknowledge your order by email - this acknowledgment email is neither an invoice nor a formal acceptance of your order - it will state what the Goods are and the cost plus p&p. Formal acceptance of your order will occur with an email confirming that we are processing your order. We will update you on the progress of your order and send an email on the date of despatch. (the "Despatch Confirmation"). That email shall represent our legal acceptance of the offer you made to buy the Goods and the Contract between us shall only be formed when we send you the Despatch Confirmation. The final invoice will be sent as a link to review in your account.
In the event that there is an error in your order or we are unable to fulfill a part of your order we will contact you as soon as possible by email or by phone and you can decide to wait until the item is back in stock, receive a replacement item or cancel your order and receive a full refund from us. If we are unable to fulfill an order we will immediately reimburse you using the same method by which you paid us.
Any error by us relating to order processing, delivery or administration will be corrected within 10 working days.
8. Returns Policy
Right to Cancel or Return of non- faulty Goods.
You have a cooling off period of 14 days from the date of delivery to cancel the contract and return the goods at your cost and receive a full refund of the purchase price.
Your statutory rights are not affected if, for any reason, you wish to return any Goods bought from us. If you are not totally satisfied with any item you have received from us then you may return it to us and we will refund your purchase price plus the cost of p & p when we despatch the item to you. All that we ask is that you:
a) return the Goods in the original manufacturer's packaging, undamaged, unused and complete; and
b) Include your Invoice Number on the outside of the Package and return it to:

c) Please note that we do not reimburse postage charges incurred when making a return and we recommend that you insure the Goods adequately.
d) Please let us know in writing (email or post) of your wish to cancel the order and return the Goods within 14 working days from the date that you receive the Goods.(the "Delivery Date"). You must return the Goods to us within 14 working days of the delivery date or within a reasonable time if not apparent on reasonable inspection - if you have not returned the Goods within this time any cancellation will be at our discretion.
We will refund the full purchase price when you have validly exercised your rights to withdraw from any purchase. Any credits due will be issued to the same card account which you used to make the purchase. If you paid by cheque a refund will be posted to you within 14 days by company cheque.
The right to cancel this contract will not apply in respect of audio or video/dvd recordings which you have unsealed or any personalised goods.
If you wish to exchange an item please contact us (by email or phone) and we will usually pay for shipping of a replacement item.
Damaged or Defective Goods
We strive to provide excellent service and best quality Goods which are free from defects in materials and workmanship. We advise that you inspect the Goods when you receive them for defect or damage and notify us within 14 working days of delivery of any defects or damage (or within a reasonable time after noticing the problem). You may either reject the Goods and receive a full refund or have the faulty item replaced free of charge. Please keep all documents and packaging in respect of the Goods when making any claim.
Where any claims are made after 14 days of delivery or exceeding a reasonable of discovery it shall be at our sole discretion whether to refund to you the price of the Goods and we shall have no further liability to you.
Delivery of the Goods shall be made by us or our carrier to the address for delivery shown in the order form. It is important that this address is accurate. Once the Goods have been delivered in accordance with your delivery instructions you will be responsible for them. Our responsibility for everything other than damage due to our negligence or due to a manufacturing design or design fault will cease upon delivery.
We will do all that we reasonably can to meet the date given for delivery or, if no date has been agreed, within 30 days of the order date. We cannot be held responsible for delays beyond our control. If we are unable to make the delivery date we will contact you. If delivery cannot be made within 30 days of the given delivery date you will be entilted to either arrange a revised date or cancel the order and receive a full refund. If we are able to make a delivery in advance of the given date we will contact you.
If the order is a multiple order and we are unable to make delivery of the whole order but are able to deliver part to you we will contact you and in this case delivery will be said to be made in instalments. Every delivery shall constitute a seperate contract and any failure by us to deliver any one or more of the instalments in accordance with these conditions or any claim by you in respect of any one or more instalments will not entitle you to treat the contract as a whole as repudiated.
If we fail for any reason within our control to fully/partially deliver your Goods any reimbursement shall be no more than the price of the Goods, together with any delivery and/or reasonable return costs.
We aim to ship your Goods within 24 hours of our confirmation of receipt of your order and w estrive to ensure that our shipping agents deliver excellent service. We will send you a Despatch Confirmation email but unfortunately no times or dates given for delivery can be guaranteed by us unless we specifically agree an individual order in writing.
In the event of non-delivery of your Goods please tell us within 21 days of placing your order that you have not received the Goods. The postal service will not acknowledge a missing parcel as lost until 15 working days from the date of despatch. You may choose to either be refunded or have the Goods reshipped if a parcel is lost in the post.
Either party is entitled to cacnel the contract in respect of non-performance of obligations in relation to delivery. If cancelled we will refund you any monies already paid by you and any reasonable return costs incurred by you.
10. Medical Disclaimer
Before beginning any new method of exercise you should consult your Doctor and Skiing or Boarding should be practised under the guidance of a qualified instructor. Myskilocker.com and its employees, will not be held responsible or liable for any injury or consequential loss arising from the use of our products howsoever caused.
11. Copyright and Trade Marks
The Material on this website is protected by copyright throughout the world and is owned by Spacehouse Ltd. The contents of this site may be read, printed and downloaded for private use but they may not be copied or commercialised without our written consent. Further, where the Goods include designs or works of art, the designer or artist owns the copyright in those works and you have no right to make any copies or adaptations of any such Goods.
12. Force Majeure
Spacehouse Ltd shall have no liability to you if we are prevented from fulfilling our obligations on account of any circumstances beyond our reasonable control whhich includes, but is not limited to, extreme weather conditions, act of God, terrorism, war, strike or difficulty in obtaining materials and/or labour.
13. Disputes and Complaints
In the unlikely event that you have a complaint about our service we will acknowledge your complaint within 3 working days and we will keep you informed as to the investigation of the complaint. Once the complaint has been investigated we will confirm our findings to you in writing.
If a complaint or dipsute cannot be resolved by direct negotition then the matter may be referred to the Safebuy mediation proceedure. <http://www.safebuy.co.uk> .
Any dispute between us will be finally determined by the English Courts and you agree to submit to the jurisdiction of those courts.
14.1 Severance : If any provision in these Terms is held to be unenforceable that will not affect the remaining provision of the Terms.
14.2 Assignment : We reserve the right to assign any of our rights and obligations under the Contract with you to a third party on the basis that the existing contractual terms will become the responsibility of that third party. You will not assign your rights without first getting our written consent.
14.3 Limitation of Liability : Our liability for any breach of these T & C's shall be limited to the total amount you have paid to us for the Goods, this is subject to any relevant consumer protection legislation including and we acknowledge that we cannot exclude liability for death or personal injury which is proved to be due to our negligence.
14.4 Your Warranty : You warrant that the information given on your order form is complete and accurate.
14.3 Governing Law: These Terms and the Contract between us are governed by English Law.
